SJC to Weigh on Prompt Payment Act
Bernkopf partner Bob Stetson will be speaking on an upcoming Massachusetts Lawyers Weekly panel addressing the closely watched J.C. Cannistraro, LLC v. Columbia Construction Co. case, currently before the Massachusetts Supreme Judicial Court.
Bob and Bradley Croft from Ruberto, Israel & Weiner will discuss the issues raised by the case and its potential impact on the interpretation of the Massachusetts Prompt Payment Act. Bob brings a unique perspective, having authored and submitted an amicus brief to the court on behalf of the Real Estate Bar Association and The Abstract Club.
The SJC recently heard oral arguments in the case. At its core, the dispute asks whether an owner or contractor that missed a deadline to object to a payment request may thereafter seek repayment of amounts it was required to pay due to technical violations of the Act.
The panel will explore the current state of the law, the questions before the SJC, and best practices for owners, contractors, and construction professionals navigating prompt payment requirements and disputes in Massachusetts. The SJC’s decision could have significant consequences across the construction industry.
