Greg will join fellow panelists Robert T. Ferguson Jr. from Hinckley Allen and Christopher K. Sweeney from Conn Kavanaugh to examine the implications of the recent Supreme Judicial Court (SJC) decision in Trustees of Boston University v. Clough, Harbour & Associates LLP. The ruling allows a negligent design lawsuit to proceed, despite the passage of time under the state’s tort statute of repose.
The SJC’s finding—that enforcement of an express indemnification clause is contractual in nature and therefore not subject to the statute of repose—has the potential to impact future claims and contract drafting in Massachusetts.
