Federal Appeals Court Halts Vaccine Mandate

On Saturday, November 6, the United States Court of Appeals for the Fifth Circuit temporarily blocked the Occupational Safety and Health Administration (OSHA)’s COVID-19 Vaccination and Testing Emergency Temporary Standard (ETS). See Bernkopf Goodman’s Client Alert for more information on the ETS.

The federal appeals court held the ETS, which mandates that companies with 100 or more employees require their workers to either get the COVID-19 vaccine or be tested weekly, put a block on the mandate citing “grave statutory and constitutional concerns.”

The Government has a deadline of 5 pm today to respond to the order.
