Boston Issues Eviction Moratorium

Last week, the United States Supreme Court struck down the Centers for Disease Control’s national eviction moratorium holding the CDC lacked authority to enact such a ban without explicit congressional authority. On Tuesday, as millions of residential tenants nationwide faced eviction, Boston’s Acting Mayor Kim Janey announced that the Boston Public Health Commission’s interim executive director signed a public health order that temporarily prohibits landlords and property owners from pursuing residential tenant eviction proceedings in the City of Boston. While the Order makes exceptions for serious violations impacting health and safety, it is not likely to withstand a legal challenge.
