Bob Stetson’s Massachusetts Exclusive Listing Agreement Dispute Featured in Law360
Law360 featured a Massachusetts Superior Court case led by Bernkopf partner Bob Stetson involving an exclusive listing agreement dispute. Bob represents Danielle M. Fleming and her brokerage, MA Properties Real Estate LLC, in this matter tied to a residential development in Lexington, Massachusetts. The defendants are Barons Custom Homes LLC and Fairland Commons LLC.
The lawsuit arises from a long-standing exclusive brokerage arrangement under which the plaintiffs marketed the development for nearly a decade. According to the complaint, the developer honored the agreement for years before repudiating it once the project became profitable, cutting the plaintiffs off from earned commissions.
The plaintiffs seek over $750,000 in damages, along with attorney’s fees, interest, and prejudgment security for the remaining unsold properties.
In comments to Law360, Bob said the matter “involves a clear breach of an exclusive listing agreement that was honored for years and then repudiated once the project became profitable.” He also added that his clients “invested nearly a decade of work and significant resources into the development and are entitled to be paid.”
